Terms of service

1. The agreement

These terms are an agreement between you and Verolant LLC, a Delaware limited liability company, 8 The Green, Ste B, Dover, DE 19901 (“RetuVPN”, “we”, “us”). They cover the RetuVPN service, our apps and retuvpn.com.

Our privacy policy, refund and cancellation policy and acceptable use policy are part of these terms. These terms are also the end-user licence agreement for our apps.

You accept these terms when you install an app, create an account or use the service. If you use RetuVPN for an organisation, you confirm you can accept these terms for it.

2. The service

RetuVPN is a virtual private network. It encrypts traffic between your device and a server we operate, then sends it to the internet from that server's IP address. This hides your traffic from the network you're connected to and hides your IP address from the sites you visit.

RetuVPN does not make you anonymous. It does not hide your identity from services you sign in to, stop browser fingerprinting, or protect you from someone who can observe both your network and our server.

3. Who can use RetuVPN

You must be at least 18 and old enough to enter a contract where you live. You may not use RetuVPN if US sanctions or export laws prohibit us from providing it to you, including if you are in a country under comprehensive US sanctions or are on a US list of restricted parties.

4. Your account

Your account is a key your device generates and a 16-digit account code we show you once. We don't hold your email address, name or phone number.

If you lose your account code and every device signed in to your account, we cannot recover the account. You can still move a paid subscription to a new account with Restore purchases, as described in recovering a subscription. Keep the code somewhere safe. Anyone who has it can use your account.

A subscription is attached to one account at a time. Restoring it moves it to the new account, and the old account returns to the free plan.

5. Free plan

The free plan has the limits shown on our pricing page. We may change or end it with 30 days' notice in the apps and on our website. Because free accounts cost nothing to create, they may have extra limits to prevent abuse.

6. Premium, billing and renewal

Premium is a subscription that renews automatically every month until you cancel.

Direct purchases

If you subscribe in our Windows app, or in the Android app installed from our website, you buy from us and Stripe processes the payment. You authorise us to charge your payment method the price shown, plus any applicable tax, when you subscribe and on the same day each month until you cancel. Prices are in US dollars.

If a renewal payment fails, we retry it for up to 7 days. If it still fails, your account moves to the free plan.

App Store and Google Play purchases

If you subscribe through the App Store or Google Play, Apple or Google sells and bills the subscription under its own terms, and you cancel and request refunds through them. They set prices in your local currency.

Price changes

We give at least 30 days' notice of a price change, in the apps and on our website. A new price applies from your first renewal after the notice period, and you can cancel before then. For store purchases, Apple or Google may also ask you to accept the new price.

7. Cancellation and refunds

You can cancel at any time. Premium continues until the end of the period you've paid for, then your account moves to the free plan. Refunds are covered by our refund and cancellation policy.

8. Acceptable use

You must follow our acceptable use policy. You are responsible for knowing whether using a VPN is lawful where you are, and for what you do through RetuVPN.

You may not resell the service, share an account beyond its device limit, get around plan limits or our security, or test our systems except as our security policy allows.

9. Licence to use our apps

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use our apps on devices you own or control, to use RetuVPN under these terms. You may not copy, modify, sell or distribute the apps, or reverse engineer them except where the law allows it despite this restriction.

Some parts of the apps are open-source software under their own licences, which apply to those parts. Each app's About screen lists them.

We own the apps, the service, and the RetuVPN name and logo. These terms give you no rights in them beyond this licence.

10. Apps from Apple's App Store

If you got an app from Apple's App Store, these terms also apply:

1. This agreement is between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
2. Your licence is limited to using the app on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, which also allow use by other accounts in your Family Sharing group.
3. We, not Apple, are responsible for maintaining and supporting the app. Apple has no obligation to provide maintenance or support for it.
4. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent these terms don't exclude them.
5. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
6. If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
7. You confirm that you are not in a country subject to a US government embargo or designated by the US government as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
8. Send questions, complaints or claims about the app to the contact details in section 20.
9. You must follow any applicable third-party terms when using the app, such as your mobile carrier's terms.
10. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

11. Apps from Google Play and the Microsoft Store

If you got an app from Google Play or the Microsoft Store, the store's terms also govern your download, and Google Play's terms govern any purchase made through Google Play. Where those terms conflict with these about the store's role, the store's terms apply to that part. Purchases inside our Windows app are made with us through Stripe, not with Microsoft.

12. Changes to the service

We improve RetuVPN over time and may add, change or remove features, locations and connection methods. If a change significantly reduces what Premium includes, we'll tell you in the apps at least 30 days in advance, and you can cancel and get a refund for the unused part of your current period.

13. Disclaimers

We work to keep RetuVPN available and able to connect, but we don't promise it will be uninterrupted, error-free or able to connect on every network. Networks and their filtering change all the time.

To the extent the law allows, we provide RetuVPN “as is” and without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't monitor your traffic, so we can't protect you from anything that reaches you through the connection.

14. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to RetuVPN is limited to the greater of the amount you paid us in the 12 months before the claim arose, and US$50.

Nothing in these terms limits liability that the law doesn't allow to be limited, such as liability for fraud, or for death or personal injury caused by negligence.

15. Responsibility for misuse

If a third party makes a claim against us because you broke these terms or the acceptable use policy, you agree to cover our reasonable costs from that claim, including legal fees, to the extent the law allows.

16. Suspension and termination

We may suspend or close an account that breaks these terms or the acceptable use policy, that harms our service or other people, or where the law requires it. Where it is possible and lawful, we'll warn you in the app first.

If we close a paid account for a reason other than your breach, we refund the unused part of your current period.

You can stop using RetuVPN and delete your account at any time. Deleting your account cancels a direct subscription straight away, and any paid time left ends with the account. App Store and Google Play subscriptions must be cancelled in the store.

17. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes will be decided by the state or federal courts located in Delaware, and we both agree to their jurisdiction. Either of us may instead bring a claim in small claims court if it qualifies.

If you live in the European Union or the United Kingdom, you keep the protection of the mandatory consumer laws of your country and may bring a claim in your local courts.

Before starting a claim, please write to [email protected] and give us 30 days to try to resolve it.

18. Changes to these terms

We may update these terms. For material changes, we'll give at least 30 days' notice in the apps and on this page before they take effect. If you keep using RetuVPN after that, the new terms apply. If you don't agree, cancel before they take effect.

19. General

If part of these terms can't be enforced, the rest still applies. If we don't enforce a right, we haven't waived it. You may not transfer this agreement. We may transfer it to a business that takes over RetuVPN and will tell you if we do. These terms and the policies they include are the entire agreement between you and us about RetuVPN.
